I am currently having the same problem with Esports saying they did not recieve a letter - My terms and conditions do not state that all correspondence has to be sent recorded delivery!! Rio, do you send your cheque to pay your bills recorded delivery?? I bet you don't. I fully understood the terms and conditions - I also hand delivered my second letter for which I was not given a reciept at the Esporta centre. I would also note that any change that Esporta makes to a members terms such as a change in monthly subscription, partial closure of facility etc is not communictaed by recorded delivery only by a first class mail letter - and yet when asked what would happen if I refused to pay the increased fee due to not receiving the letter I was told it was tough luck the letter must have been lost in the post!

They cannot have it both ways

I’m sorry but I hear this so many times that people send letters in and they haven’t put it on the system and they haven’t done this when I have done that... if you clever enough to sign a contract and commit to something then read the terms and conditions. Terms and conditions are there to protect the customer as well as the seller. if you have something important to send why do people insist on sending it first class not recorded that way you have proof they have received it. And when you go into large companies and hand deliver a letter get a receipt for it. You wouldn't just send a letter to your bank making important changes without either going into see them or sending in a letter recorded delivery. It is easy to blame others for your mistakes. And if it is the second time they have done this then why haven't you read the terms and conditions properly to make sure you would have done the above correct. I work for a legal company and I get these all the time and to be frank its 99% the person that is complaining about how nasty or money grabbing the company are is down to the fact they have not followed the a simple rule... don’t sign for something you don’t understand.

We hope Esporta Lichfield will show compassion and resolve this matter without need to bring action in the petty claims courts. www.complaintsboard.org.uk with then cease publication of negative publicity.
